Welcome to Athena Virtual Productions, Inc., ("AVPI") Battlelords of the Twenty-Third Century ™ ("THE GAME") for Facebook©, Twitter© and other mobile/social networks.
Section 1 - LICENSING
Use of THE GAME is solely for personal non-commercial entertainment purposes via authorized game client services. You agree and may not use THE GAME, its software, intellectual property (IP) or services for any other purpose. You agree that any other use, including "Hacks/hacking", "Cheats" "Outsourcing" "Mods" "Bots" etc., would be construed as as violation the the TOUA and an infringement of the copyrights and privileges of AVPI. You agree that violations of the above and or, any attempt to disrupt THE GAME will result in the termination of game services with violators subject to the enforcement of all applicable criminal and civil laws.
Section 2 - OWNERSHIP
You agree that having a game account and playing THE GAME does not give you ownership rights to any aspect of THE GAME or its accounts. These include its IP, effects, "Apps", artwork, music, dialog, phrases, methods of game play, stories, code, themes, methods, characters, blog-posts, forums, objects, titles, media or authorized Licensors and Licensees. Furthermore, you acknowledge and agree that all rights to THE GAME and its accounts belong now and forever to AVPI. Be advised that THE GAME is protected by United States and international laws and AVPI will vigorously enforce those rights under law.
Section 3 - WHO CAN PLAY THE GAME
You agree that by selecting "I AGREE", you are (A): representing yourself as an adult defined by the laws in the country of your residence and (B): representing yourself as an adult who is the legal Guardian or Custodian of a Minor Child in your care (as defined by the laws in the country of your residence) who, at your discretion is authorized to play THE GAME.
Section 4 - GAMER CONDUCT CODE
THE GAME is governed by rules and those rules will be enforced by AVPI. As a gamer you agree that all gamers must take the responsibility to abide by the rules of THE GAME TOUA.
Additionally, by agreeing to the terms of THE GAME code of conduct rules, the use of language that is foul, obscene, hateful, defamatory, threatening, abusive, harassing, vulgar, culturally, racially, sexually and ethnically offensive will not be tolerated and the discussion of criminal behavior in any way is completely prohibited.
You agree not to take the name of anybody else, impersonate anyone else including a member of AVPI, disseminate personal or embarrassing information about yourself or other persons/gamers, co-opt a copyright, trademark or service mark, use gibberish, denigrate religious persons or icons, impose commercial solicitations (SPAM) for advertisements, commercial enterprises or groups, send unwelcome messages and or disrupt the normal flow of game play, chat/dialog rooms or forums by any means. Additionally for the sake of "Fair Play" you agree to not publicly exploit flaws, code errors, program "bugs" or other undocumented issues with THE GAME or communicate any information that would give you or other gamers an unfair competitive edge in THE GAME. You agree that AVPI may terminate, delete, suspend or modify any GAME account without notice or cause for any reason as a result of violations of this TOUA conduct code.
We will not sell your non-public information to non-affiliated 3rd parties however, we fully reserve the right to use aggregated or anonymous data about use of and activity on THE GAME to assist us in in providing game and game related related services. We will not send you emails and or promotional email outside the scope of THE GAME. To protect our rights and our users. There may be instances when we may access, preserve and disclose user information without providing notice or choice, if required to do so by law or if based on a good faith belief that such access, preservation or disclosure is reasonably necessary to (a) comply with the law or legal process; (b) enforce this Agreement; (c) respond to claims that any content or information violates the rights of any third party; (d) respond to your requests for customer or technical service; or (e) protect the rights, property or personal safety of Company, users or any third parties including those acting in urgent circumstances.
To complete a merger or sale of assets. If we sell all or part of our business or makes a sale or transfer of its assets or are otherwise involved in a merger or transfer of all or a material part of its business, we may transfer your user information to the party or parties involved in the transaction as part of that transaction.
Section 6 - CHANGES TO THE TOUA
AVPI reserves the right at its sole discretion to to change, modify, add, delete or supplement any and all rules of this TOUA at any time for any reason and that those rules may not be applied retroactively. In addition, AVPI reserves the right to change, modify, delete, embellish, enhance and add new content, data, media, services and features effecting the playing of THE GAME at any time.
Should any future changes be deemed unacceptable by you, or cause you to fail in your compliance with this TOUA, you agree to immediately stop using THE GAME and terminate your account. Be advised that continued use of THE GAME constitutes your complete and irrevocable acceptance of any and all changes.
Section 7 - TERMINATION
This Agreement is in full effect until terminated. You may terminate this Agreement at any time by deleting your account and all accounts registered by you. You knowledge and agree that should you decide to terminate your account(s), you forfeit your right to any and all payments made by you prior to your decision to terminate. Sections 1, 2, 8 and 9 survive any termination of this Agreement.
Section 8 - WARRANTY DISCLAIMER
NO warranty express or implied. You acknowledge and agree that you are playing THE GAME "AS IS" "AS AVAILABLE" and AVPI does not warrant THE GAME to be error free, uninterrupted or devoid of possible harmful "viruses". Further, as the makers of THE GAME, you acknowledge and agree that AVPI is not responsible for changes in policy, accessibility, playability and Terms of Service effecting THE GAME due to changes on the part of Facebook©, Twitter© and or any other mobile/social network in which THE GAME appears. AVPI shall not be liable for any delay or failure to to perform resulting from cause and/or unforeseen circumstances beyond our control including but not limited to, war, terrorism, riots, embargoes, fire, flood, geological instabilities, accidents, strikes, acts of civil or military authorities, electromechanical failure, transportation, fuel, energy, labor, material shortages or acts of God.
Section 9 - INDEMNIFICATION
You agree to defend, indemnify and hold harmless AVPI, its Subsidiaries and Affiliates, from and against any claim, liability, injury, damage, loss or expense including reasonable attorney's fees incurred as a result of, arsing from, or relating to your use of THE GAME and/or its service or services.
